Smyrna police say Dylan Scott Levesque, 23, has been charged with aggravated child abuse and neglect in the death of his 3-year-old son, Daylin Palmer. The Rutherford County Ambulance Service and the Smyrna Police had responded to 707 Windbirch Trail, the father’s home, for an unresponsive child shortly before 5 pm yesterday, where they discovered Daylin had succumbed to heatstroke, the Smyrna Police Department said. Levesque’s bond has been set at $50,000; his court date has been set to July 15.
Police believe the boy was left in the hot car for at least 2 hours as outdoor air temperatures were in the mid 90’s. According to the National Weather Service, it is likely temperatures inside the car rose to more than 135 degrees in an hour.
After crimes punishable by death or life imprisonment, class A felonies are the most serious felonies in Tennessee. The Class A crime Levesque has been charged with is punishable by 15 to 60 years in prison and a fine of up to $50,000.
